1. Overview

Character Tavern is a platform that provides AI-generated chat services and a character-sharing feature, where users can upload and share cards containing metadata. The platform is open to users aged 13 and older, with access to NSFW content restricted to users aged 18 and older. By accessing or using our platform, you agree to comply with these Terms of Service (ToS), our Privacy Policy, and our Content Guidelines.

2. Eligibility

To use Character Tavern, you must be at least 13 years of age. To access NSFW content, you must be at least 18 years old. By using the platform, you affirm that you meet the age requirements. We reserve the right to restrict access or suspend accounts for users who misrepresent their age.

3. User Accounts

To access certain features of the platform, you must create an account. You agree to provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account login credentials and for all activities conducted through your account.

4. User-Generated Content

Users can upload and share content in the form of cards (PNG files with metadata). By uploading content, you retain ownership of your work, but you grant us the right to modify or delete content for moderation, correction purposes, or to comply with our Content Guidelines.

4.1 Content Moderation

Content is moderated primarily through a user-reporting system. If your content is reported and found to violate our guidelines, it may be removed, and your account may be subject to suspension or termination.

5. Acceptable Use

You agree not to use the platform for any illegal or harmful purposes, including but not limited to:

• Harassment, abuse, or spamming.
• Posting harmful or offensive content, including hate speech, violent imagery, or explicit content without proper categorization.

Violation of these guidelines may result in account suspension or termination at our discretion.

6. Paid Features and Subscriptions

Character Tavern offers premium features available through subscription. Payments are processed in U.S. dollars, and subscriptions auto-renew unless canceled through the billing portal in your account settings.

6.1 Refund Policy

We offer a 14-day refund period for premium subscriptions, provided no AI-generated messages have been sent. To request a refund, please email us at sal@character-tavern.com. Once a message is generated, the refund policy is voided.

7. Third-Party Services

We integrate with several third-party services to provide a seamless experience. By using the platform, you acknowledge and agree that the following third-party services may collect and process your data:

• Sentry: For error tracking and monitoring.
• PostHog: For analytics and user interaction tracking.
• Stripe: For payment processing.
• OpenRouter: For AI generation services.
• AWS & Vercel: For hosting and cloud services.

We do not assume liability for issues arising from the use of these third-party services. For details on how these services handle your data, refer to our Privacy Policy.

8. No Guarantee of Uptime

We do not guarantee the platform will be available at all times. Maintenance, updates, or unexpected outages may occur. You acknowledge and agree that Character Tavern is not liable for any downtime or service interruptions.

9. Termination of Service

We reserve the right to suspend or terminate your account if you violate these ToS or our Content Guidelines. Termination may occur without prior notice, although we will attempt to notify you when possible.

10. Limitation of Liability

To the maximum extent permitted by law, Character Tavern and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the platform, even if we have been advised of the possibility of such damages. In no event shall our total liability exceed the amount you paid for the use of premium services, if any.

11. Modifications to Terms of Service

We may modify these ToS at any time. When changes are made, we will notify you via email. Continued use of the platform following changes to the ToS will constitute your acceptance of the revised terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United States, without regard to its conflict of laws principles.
